Start with the process, not the lawyer
Divorce in Canada is federal law under the Divorce Act, applied in Ontario by the Superior Court of Justice. The usual ground is living separate and apart for one year — you can file before the year is up, but the divorce order issues only after it. Parenting, support and property issues can be resolved by agreement or decided by the court alongside the divorce.
Understanding that framework changes how you shop for a lawyer: you are not buying aggression, you are buying someone who can move you through a defined process at the lowest total cost — financial and emotional — that still protects you.
The evaluation checklist
- Licensed and in good standing with the Law Society of Ontario (check the public directory)
- Family law is a core part of their practice, not a sideline
- They explain both settlement routes (negotiation, mediation, separation agreement) and court routes — and when each fits
- Fees are explained in writing: hourly rate, retainer, and what happens when the retainer runs low
- You can communicate comfortably — including in Urdu, Punjabi, Hindi or Polish if that is easier for you
Red flags
- Guarantees about outcomes — no honest lawyer promises results
- Pressure to litigate immediately when you have not tried to settle
- Vague fee answers, or reluctance to put the arrangement in writing
- A consultation where you did most of the listening and none of the understanding

The content of this website is legal information about Ontario and Canadian law, not legal advice. Reading it, or contacting us through it, does not create a lawyer-client relationship — that begins only after we confirm in writing that the firm is acting for you.
