What is my first step if my marriage has fallen apart?

Many of our clients contact us immediately after they know there is no prospect of reconciliation of their marriage. What does separation mean?

Couples are distinguished as separated within the meaning of the law usually when they begin to live separate and apart from each other with no change of reconciliation. Separation is often misunderstood as ‘living under a separate roof’ this may not always be the case. In Ontario, Canada you have the right to remain under the same roof but to declare a separation in your relationship.

At this juncture you may unilaterally announce that you have separated from your spouse without the other’s consent. We suggest marking this date as it becomes an important time stamp at the time of applying for a divorce.

What does it mean to divorce?

A divorce is a legal end to your relationship. To which parties may file and service a joint-application, simple application, or an application. It is recognized in law once an Honourable Justice issues an Order endorsing an end to the relationship. The Order will usually take effect 30 days after issuance.

Will I have to go to Court for a divorce?

No. You do not have to go to Court for your divorce process if all parties are agreeable to proceeding in an amicable manner. Often times we call this a ‘clean break’. Our lawyers encourage parties to stay out of Court and resolve their family law matters outside of Court.

How can I ensure that my divorce will not be expensive?

We believe your legal fees are usually within your control. Lawyers can only proceed when they seek your instructions. Our lawyers encourage clients to proceed with an amicable approach in mind to ensure costs remain low.
